These Terms & Conditions are intended, together with the order form and the other elements referred to therein, to regulate the terms and conditions governing the provision of the PCByte Online Shop service by JWeb Lda, with registered office at Rua Milho da Ponte no. 59, 3250-254 Maçãs D. PCByte provides a Customer Service through which the Customer may, at any time, contact PCByte to request clarifications, make suggestions or submit complaints at the following contact: +351 965 650 262.
The Service consists of providing, through the address https://pcbyte.pt/ (hereinafter PCByte), access to the Online Shop which, in addition to providing information regarding a set of products and/or services, allows the Customer to electronically order the products advertised therein, under the terms and conditions described herein.
The ordering of products must be carried out by Customers aged 18 (eighteen) or older (younger individuals must have authorisation from their representatives).
The elements and information transmitted by the Customer shall have full legal effect, with the Customer acknowledging electronic purchases and being unable to invoke the absence of a signature for failure to comply with the obligations assumed.
The PCByte Online Shop and subdomains are registered sites and the property of JWeb. The intellectual and industrial property rights contained on the website pcbyte.pt, its name, graphics, software code, trade marks and distinctive signs are the property of JWeb, except where indicated as belonging to another holder.
Any use, reproduction, copying or disclosure of its content by third parties, without prior authorisation from JWeb, constitutes an infringement of the intellectual and industrial property rights protected by law.
The User acknowledges that the Service contains confidential information and is protected by copyright and related rights, industrial property and other applicable legislation.
The User acknowledges that any content appearing in the advertising, featuring, promotion or mention of any sponsor or advertiser is protected by laws relating to copyright and related rights, laws relating to industrial property and other property protection laws, and any use of such content may only take place under the express authorisation of the respective holders.
The User undertakes to fully respect the rights referred to in the previous paragraph, in particular by refraining from any acts that may infringe the law or such rights, such as the reproduction, commercialisation, transmission or making available to the public of such content, or any other unauthorised acts in respect of the same content.
PCByte products presented in the PCByte shop clearly indicate their availability and may be out of stock, identified as "Unavailable".
The Customer can request to receive a stock notification, by accepting the GDPR terms set out herein, obtaining information about the restocking of the product in the shop (without minimum prior notice).
PCByte reserves the right to modify or suspend, for an indefinite period, the products presented on the PCByte product pages without prior notice to the Customer.
If you purchase a product with characteristics different from those presented online, you have the right to terminate the purchase contract under the applicable legal terms (right of free withdrawal).
PCByte will do everything possible to ship all of the ordered products, but it is possible that, in certain cases and due to causes hardly controllable by PCByte, such as human error or incidents in computer systems, it is not possible to provide some of the products requested by the Customer. If a product is unavailable after you have placed your order, you will be notified by email or telephone.
At that moment, you will be offered the possibility of cancelling the order with the corresponding refund of the amount previously paid, which will be processed via the same payment method or another means of your choice, if you have already made the corresponding payment.
PCByte will do its utmost to ensure that the information presented does not contain typographical errors and these will be corrected promptly whenever they occur.
All information about price, products, specifications, promotional actions and services may be changed at any time by PCByte.
The PCByte site contains links to other websites, which may contain information or tools useful to its users. These PCByte Terms & Conditions do not apply to third-party websites. As such, if the Customer visits another website, redirected from the PCByte site, they should read and accept the terms and conditions and privacy policy thereof.
PCByte will not assume responsibility for campaigns and advertisements that use the PCByte brand without legitimacy to do so.
PCByte guarantees that all content and services offered on the PCByte site respect the principle of personal dignity, the principle of non-discrimination on grounds of race, sex, religion, opinion, nationality, disability or any other personal and social circumstance, as well as the principle of the protection of youth and childhood.
The information and documentation available in the Portuguese, English and Spanish versions on this website are provided for informational purposes only. In the event of any discrepancy, the prevailing content shall be the Portuguese version.
In order to make purchases in the PCByte online shop and benefit from other advantages and features, the user must submit a registration request on the website. This request is reviewed by the PCByte team, and the granting/creation of the account is at the discretion of the PCByte team responsible for the process.
After receiving the website-access confirmation email, the user becomes a "Customer".
PCByte reserves the right to limit and modify the access of the customer account that breaches any of the obligations mentioned in the "Customer/consumer obligations".
The sale prices indicated on the PCByte online shop site are presented in euros. VAT and other applicable taxes or duties are included in the purchase process, after adding to the cart.
PCByte reserves the right to change the prices of products in the PCByte online shop without prior notice.

Receiving and collecting orders for products purchased via the PCByte online shop can be done in two ways:
The Customer can collect their order at the PCByte premises in Alvaiázere, at the following address: Rua Milho da Ponte no. 59, 3250-254 Maçãs D. Maria.
It is the Customer’s responsibility to provide the correct identification details for delivery, with PCByte being exempt from liability in case of incorrect indication of mobile number, email and address details.
The Customer can track the status of orders in the User Profile, on the PCByte website, under "My orders".
At the Customer’s request, the Customer may cancel the order, provided that it has not yet been shipped or processed, by informing PCByte by email or telephone using the contacts presented herein.
PCByte reserves the right not to process orders, when it detects any inconsistency in the personal data provided or observes misconduct on the part of the buyer.
PCByte reserves the right not to process any order or refund where errors are found in the values and/or characteristics of the products, when these arise from technical problems or errors beyond PCByte’s control.
The customer/consumer may return the equipment purchased within 15 days. Returned goods will only be accepted if they scrupulously meet the following conditions:
In case of breach of any of these points, we will not be able to accept the return (and consequent refund) or the exchange.
If the customer/consumer scrupulously respects the foregoing conditions and is entitled to a refund, the amount previously paid will be refunded via the same payment method or other means of your choice, if you have already made the corresponding payment.
All equipment available in the PCByte shop is duly certified by the relevant international bodies.
Equipment and accessories have a warranty period set by the manufacturer, which under legal terms is at least 2 (two) years. This period runs from the date of the equipment’s invoice and can only be exercised upon presentation of the duly completed warranty certificate and/or proof of purchase (invoice). Some materials have a warranty longer than 2 years, given by the manufacturers.
Equipment that has exceeded the period defined by the manufacturer or shows defects caused by abnormal wear, improper installation, weather, electrical surges, negligence or accidents, mishandling, infiltration of moisture/liquids, use of non-original accessories and technical interventions by unauthorised personnel is considered outside the warranty conditions.
If the equipment fails and is covered by the warranty, the Customer may take it together with the respective proof of purchase and/or warranty to a brand-authorised technical assistance centre.
Accessories covered by the warranty that fail must be sent, with the respective proof of purchase and/or warranty, to the following address: JWeb Lda — Rua Milho da Ponte no. 59, 3250-254 Maçãs D. Maria, Portugal.
If the Customer opts for other forms of return, the respective shipping costs will be at their expense. The Customer must always request the CTT receipt that proves the dispatch of the parcel.
If the equipment fails and the failure is not covered by the warranty, the Customer may send it to us, to be passed to the manufacturer, so that we can estimate the cost of repair.
All products and services marketed in the PCByte Online Shop comply with Portuguese law.
The shop has appropriate levels of security; however, PCByte will not be liable for any damages suffered by the Customer and/or third parties as a result of delays, interruptions, errors and suspensions of communications originating from factors beyond its control, in particular any deficiencies or failures caused by the communications network or communications services provided by third parties, by the IT system, by modems, by connection software or any computer viruses or arising from the downloading, through the file service, of files that are infected or contain viruses or other properties that may affect the Customer’s equipment. If, for any reason of access error to the PCByte Online Shop electronic site there is an inability to provide the service, PCByte will not be liable for any damages.
Data and information consultations carried out under this service are presumed to be carried out by the Customer, with PCByte declining any liability arising from the abusive or fraudulent use of the information obtained.
PCByte will not be liable for any losses or damages caused by abusive uses of the service which are not directly attributable to it by way of intent or gross negligence.

If any data is incorrect or insufficient, and for that reason there is a delay or inability to process the order, or eventual non-delivery, the responsibility lies with the User, with PCByte declining any liability.
If the consumer breaches any of these obligations, PCByte reserves the right to refuse future purchases, block access to the shop, cancel the supply of any other services provided simultaneously by PCByte to the same User, and to deny the User future access to any service made available by PCByte.
In the case of a "manufacturing defect", that is, when faults are detected in equipment that, in principle, do not fall within the scope of the respective warranty, the User shall return the equipment, together with a copy of the invoice and the completed "Equipment Exchange/Return Request" form, within a maximum of 10 consecutive days from the invoice date, to the following address: JWeb Lda — Rua Milho da Ponte no. 59, 3250-254 Maçãs D. Maria, Portugal.
If the User opts for other forms of return, the respective shipping costs will be at their expense.
For the exchange of the product to take place, the User must ensure that the packaging is complete (box, instruction manual, warranty certificate, terminal and accessories) containing all the components that make it up, in excellent condition.
In the absence of any of the elements mentioned above, or if any of the components is not in excellent condition, no exchange will take place and the product will be returned to the User.
Without prejudice to other forms of communication provided for in these Terms & Conditions, notifications to the Customer relating to the Service, including any changes to these Terms & Conditions, may be sent to the Customer’s email address or telephone contact.
The Customer accepts to receive any communication and/or notification related to orders placed by them, by an associated employee on the account, or by their sales representative, on the PCByte online shop, to the email address, telephone contact or address given during the order process.
At any time, you may request not to receive PCByte newsletter communications, through "Subscription management" in the user profile. The same process applies if you wish to start receiving the PCByte newsletter, this being an exclusive advantage for PCByte Customers.
The Contract is governed by Portuguese law.
